Terms of Service

These Terms of Service ("Terms") are an agreement between you and Lootfun, Inc. ("Lootfun", "we", "us") governing your use of lootfun.app and the Lootfun mobile app — a surprise-shopping experience where you open curated boxes from published catalogs and receive, keep, trade in, or ship real products.

About the current preview: the interactive demo on this site uses virtual Loot credits only, stores everything locally in your browser, and involves no real purchases, prizes, or shipping. Sections of these Terms that concern payments and fulfillment apply to the full service at launch.

1. Agreeing to these Terms

You accept these Terms by creating an account, clicking "I agree," or simply using the service. If you do not agree, do not use Lootfun. Where we reference other policies — including our Privacy Policy — they are part of these Terms.

2. Changes to these Terms

We may update these Terms from time to time. Updated Terms take effect when posted, and we will revise the "Last updated" date above; for material changes we will give additional notice in the app or by email. Continued use after an update means the revised Terms apply to you. If you do not agree with a change, stop using the service and close your account.

3. Overview of the service

Lootfun is a retail experience, not a game of chance with losing outcomes:

  • Every box belongs to a pool with a published product catalog, and every opening reveals one real product from that catalog — there are no empty boxes.
  • The odds for each rarity tier are disclosed on the pool page before you open, and always total 100%.
  • Pools rotate: we may add, change, or retire pools and catalog items at any time. Retiring a pool never affects items you have already revealed.

4. Eligibility

You must be at least 18 years old (or the age of majority where you live), able to form a binding contract, and not barred from using the service under applicable law, including sanctions and export-control rules. The service is void where prohibited.

5. Your account

  • Provide accurate information and keep it current.
  • One account per person. You are responsible for all activity under your account and for keeping your credentials secure — tell us immediately at support@lootfun.app if you suspect unauthorized access.
  • We may suspend or close accounts involved in fraud, abuse, or violations of these Terms.

6. Loot credits

  • Loot credits are a virtual currency used to open boxes. They can be purchased, or earned through promotions such as referrals.
  • Loot credits are a limited license, not property: they have no cash value, cannot be transferred, sold, or exchanged outside the service, and cannot be redeemed for money except where required by law.
  • Purchases of Loot credits are processed by third-party payment providers and, except as required by law or expressly stated otherwise, are final and non-refundable. Prices exclude applicable taxes.
  • We may adjust or remove credits obtained through fraud, error, or abuse of promotions.

7. Opening boxes

  • Opening a box deducts its price in Loot credits and immediately reveals your item. Once an opening starts, it is final — openings cannot be canceled, reversed, or refunded.
  • Revealed items are held in My Loot until you decide what to do with them: keep collecting, trade in, or request shipping. Items do not expire, and nothing in the service requires you to open more boxes.
  • Product images and retail values shown in catalogs are for reference; actual colorways or packaging may vary for comparable versions of the same product.

8. Trade-ins

  • You may trade in an unshipped item for Loot credits at the rate displayed before you confirm. The rate is below the item’s listed retail value and is shown up front — accepting a trade-in is always your choice, never automatic.
  • A confirmed trade-in is irreversible: the item is removed from My Loot and the credits are added to your balance.
  • Items that have been shipped or requested for shipping cannot be traded in.

9. Shipping and delivery

  • You may request shipping for any revealed item to a supported address. Shipping fees and estimated timelines, if any, are shown before you confirm.
  • You are responsible for providing an accurate address. Title and risk of loss pass to you on our delivery of the item to the carrier; delivery estimates are not guarantees.
  • If a shipment is returned as undeliverable, we will contact you to arrange redelivery; additional fees may apply.
  • Because every item is revealed from a published catalog before shipping, shipped items are returnable only where required by law or if they arrive damaged or materially not as described — contact support within 14 days of delivery.

10. Referrals and promotions

Referral rewards, bonus credits, and other promotions are offered at our discretion: rates are estimates, may change, and may be modified or discontinued at any time. Self-referrals, fake accounts, and other abuse void the associated rewards.

11. Community features

Features like the live wins feed and leaderboard display your chosen display name and revealed items to other users. Choose a display name you are comfortable sharing; names that are offensive, misleading, or infringe others’ rights may be changed or removed.

12. Prohibited activities

When using Lootfun, you must not:

  • break the law, or use the service for any unlawful purpose;
  • commit fraud, including payment fraud, chargeback abuse, or promotion abuse;
  • use bots, scripts, scraping, or automation, or attempt to interfere with, reverse engineer, or gain unauthorized access to the service;
  • circumvent geographic or eligibility restrictions, including via VPN;
  • harass or harm other users, or infringe anyone’s intellectual property;
  • resell, commercially exploit, or misrepresent the service or your account.

13. Third-party services

The service relies on third parties — payment processors, shipping carriers, sign-in providers, and app stores — that operate under their own terms and privacy policies. We are not responsible for third-party services, and disputes with them are between you and the third party, though our support team will help where we reasonably can.

14. Mobile app license

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the Lootfun app on devices you own or control. Keep the app updated; outdated versions may not work correctly or show accurate information.

15. Intellectual property and feedback

The Lootfun name, logo, coin, mascot, and all content and software in the service are the property of Lootfun, Inc. or its licensors and may not be copied, modified, or used to build competing products. Third-party brand names appear to identify genuine products and imply no partnership or endorsement. If you send us feedback or suggestions, you grant us a perpetual, royalty-free right to use them without restriction or compensation.

16. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure. Lootfun is not your broker, advisor, or fiduciary, and nothing in the service is investment, tax, or legal advice — items and credits are for enjoyment, not investment.

17. Limitation of liability

To the fullest extent permitted by law, Lootfun and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for all claims is capped at the greater of the amount you paid us in the 180 days before the claim arose or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

18. Indemnification

You agree to indemnify and hold Lootfun and its affiliates harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the service, your violation of these Terms, or your violation of another’s rights.

19. Dispute resolution and arbitration

  • Talk to us first — most issues can be resolved quickly by emailing support@lootfun.app.
  • Binding arbitration — any dispute that we can’t resolve informally will be settled by binding individual arbitration under the rules of the American Arbitration Association, conducted in English, remotely or at a mutually agreed location. Small-claims court remains available for qualifying claims.
  • Class-action waiver — disputes must be brought individually; class, collective, and representative actions are waived to the extent permitted by law.
  • One-year window — claims must be filed within one year of the events giving rise to them, where permitted by law.

20. Termination

You may stop using Lootfun and close your account at any time. We may suspend or terminate accounts that violate these Terms or where required for legal or security reasons. On termination, your license to use the service ends and unused promotional credits lapse; revealed items you are entitled to and paid balances are handled as required by law. Sections that by their nature should survive — including 15 through 19 — survive termination.

21. Miscellaneous

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them. We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, pandemics, cyberattacks, or infrastructure failures. We may provide notices electronically, including in the app and by email. These Terms, together with the policies they reference, are the entire agreement between you and Lootfun about the service.
